The Creative Process

Thank you for considering working with me on your creative project! I find it useful to clarify beforehand what we can both expect during the creative process. It is also important to outline the terms of our agreement to work together so that we know what to do in the rare case that something doesn’t go as planned.

There are usually several stages to a design project that include researching, developing a design, refining the design and presenting the deliverables in an appropriate format. In between each stage I will be in touch with you for feedback and approval on designs. If you have strict deadlines, it is important that it is mentioned in your design brief, and that all communications between us are timely to avoid delays. My intention is always to complete projects on time but I cannot guarantee that project deadlines are met if feedback, sign-off on drafts, necessary resources / content / materials are not provided by a client in good time. Let me know if you have a preferred method of communication – a favourite app, video calls, or email – we can make it work. I will send updates and documents via email for you to review. There may be occasion when I work with other creators to complete your project but I will be your main contact unless otherwise agreed.

I will always try to find out as much as possible about your project before beginning work. My goal is to create something that will help you to reach your goals so it is useful if you have a design brief prepared, or some ideas about the goals of your project that we can discuss in more detail together. I will be doing some research on competitors and similar concepts for the project but feel free to share a Pinterest board or moodboards that you have created as it is all incredibly useful in creating the best outcome for your brief.

I reserve the right to decline any offer of work or collaboration for any reason. It may be the case that a project does not align with the ethics of my work. However, I am open minded and keen to participate in interesting creative projects so please do share your ideas and we can see if we are a good fit to work together.

If we decide to go ahead, I will be using your design brief and any additional information and resources you provide as inspiration to create something unique, unless you have requested adaptation of existing assets. If you have some existing content that you want to include in your design such as images, fonts or text, please make sure that it doesn’t infringe on anyone’s copyright! Please supply graphic files in an editable, vector digital format. Photographs and stock images should be supplied in a high resolution digital format. If you’d like me to search for images for you, I can provide a separate estimate for that. If you need any advice on these formats I’m always happy to help. Please also proof all copy and images that you send for me to use, as there are costs for multiple revisions outside of the agreed upon amount if mistakes are found later on. I am able to provide an estimate for proofing, editing or writing copy for you if it is required. Any mistakes made by me will be fixed for free.

After getting information about the project from you, I will present a project proposal to you which will outline the scope of work I will be doing and an estimated timeline, a cost estimate, and a rundown of the legal terms and conditions. Please let me know if there’s anything in this document that you don’t agree with and we can see if there’s any way to adapt the project to be more suitable for you.

A deposit of 50% is required before work is started, and the rest when the project is completed. Payment of the deposit implies acceptance of the terms of the agreement, and that I may start work on the agreed date.

If you need to cancel the project at any time, you will be billed for any work completed up to the point of cancellation, and I will send you any work completed up to that point. If for some reason I have to unexpectedly cancel this project, I will hand over any work completed up to the point of cancellation and refund you for any payments made on incomplete work.

You will need to provide feedback and approval at various stages of the design process. Feedback needs to be specific, preferably with examples. Approval must be given in writing via email. Please provide confirmation of your approval via email if we spoke about it in person or on the phone.

Once you provide approval for a design, the design is considered final. Any work outside of the scope of the project (for example if there are lots of changes that we hadn’t agreed to) will be charged at an hourly rate and invoiced with the final payment. When the work is paid for in full, I transfer rights to the artwork to you to use as you wish. This includes image files in a format we agree on, that would be suitable for the intended purpose of the designs. Any edits requested outside of the agreed amount of revisions, or after approved deliverables are received by you, will be charged at an additional rate or a cost will be estimated for a new project.

Although you can use the final designs however you like, I usually provide a guide for how to make the most out of your designs that may be useful for applying the artwork in its intended settings. The guidelines explain how to make sure the design remains impactful and does the job it is meant to do. Please let me know if you need help applying designs to your products, marketing materials or other areas of your business. Don’t forget to schedule a free 6 month or annual review when we can discuss if anything needs updating as your business needs change.

The creative process and final creative outcomes may be included publicly on my website, in my portfolio, or in other marketing materials for the purpose of showing work that I have done. Private business information and personal information that are not publicly available are kept confidential. Please let me know if there are parts of the artwork or designs you prefer not to be shown.

This website is built using the website-builder Squarespace and utilises other third party apps which have their own terms, conditions and privacy policies that I have to follow and can’t control. I would only knowingly work with reputable service providers, however, for your own peace of mind it is best to read the terms and conditions and privacy policies of any third-party web sites or services that you use as a result of visiting alexmakes.co. I am not able to take responsibility for the policies, content or practices of any third party websites or services.

Any content added to the website has permission to be uploaded to the site or is property of the owner of the website. Do not download, edit or distribute any content from the site unless it is to share directly to social media with the appropriate credit given (tag the creator, please!).

If you create an account, subscribe or register with Alex Makes, you confirm that the personal information you have given is correct and complete. You also agree to receive occasional communications that are relevant, informative and not spammy! You can let me know any time if you would like me to take you off the mailing list, update or delete your account. I will take all reasonable measures to protect your privacy and all information that you provide. If you need to use a password to access any part of the site, please keep your log-in information private.

Paying for Products and Services

When paying for an item or a service, make sure that you have read through the full listing / proposal, and terms and conditions provided before making a commitment. You are entering into a legally binding contract when you pay a deposit or complete the checkout process.

The products and services available on this website may change at any time and I can’t guarantee that some items will be available again at a later date, or at the same price, unless we make a long term agreement for this to be the case. Prices may be changed at any time, or corrected if there was an accidental error.

If you order handmade products please expect that there will be variations between each product, and differences compared to examples shown in images online. As with anything you buy online, colours and textures may vary. I will try my best to give a good description of products that are listed but if you need any other information please get in touch.

In addition to the price of the products, you may have to pay a delivery charge for physical items which you will be notified of before any contract comes into force. Make sure that your billing and shipping details are correct to avoid administrative issues and delivery to the wrong address. There may be fees for payments not received.

Custom creative services provided by Alex Makes require a 50% deposit up front and remaining payment on approval of the final design. If a payment is not received, I have the right to claim payment of the agreed price as well as interest on the late payment based on the legal rate at the time and administrative fees of 10% of the amount of the agreed price, with a minimum of £30, unless there is proof of greater damages. I am also entitled to postpone delivery of products or services, or to consider the agreement as terminated due to the client. In that case, I am entitled to claim an indemnity of 30% of the amount of the agreed price, unless there is proof of greater damages.

If you make an unjustified credit card, debit card or other charge-back then you will be liable to pay within 7 days following the date of a written request: an amount equal to the amount of the charge-back; all third party expenses incurred in relation to the charge-back (including charges made by my or your bank / payment processor / card issuer); an administration fee of GBP 25.00 including VAT; and all reasonable costs, losses and expenses incurred in recovering the amounts referred to in this section (including legal fees and debt collection fees). And for the avoidance of doubt, if you fail to recognise or fail to remember the source of an entry on your card statement or other financial statement, and make a charge-back as a result, this will constitute an unjustified charge-back for the purposes of this section of the terms, in regards to payment recovery.

Alex Makes and / or affiliated companies will issue an invoice or credit memo for any payment of Fees or refund made to or by Alex Makes. Each Invoice will be made available to you via your User Account and / or by e-mail. For certain local laws, you may be required to provide personal information in order to issue the invoice. Please note that the Invoice presented to you may be inadequate with your own local law requirements, and in such case may be used for pro forma purposes only.

I always aim to do a good job and help you reach your goals. If we have entered into a contract and an issue comes up that is out of my control, I will do my best to rectify it or reschedule the project. I will keep you updated if there are any known issues impeding the work.

Deliveries and Returns of Ready-Made Products

(not applicable to custom designs and services – for those you will be provided with estimated timescales for completion and / or delivery)

I will make all reasonable efforts to deliver your products on or before the date for delivery set out in the order confirmation or, if no date is set out in the order confirmation, within 7 days following the date of the order despatch; however, I do not guarantee delivery by this date. Unless there are exceptional circumstances, all deliveries of products will be dispatched within 21 days following either the receipt of payment or the date of the order confirmation. Custom or personalised orders vary in the time taken to complete and despatch. For those orders I am able to provide an estimate of the time it may take, although the estimate may be subject to change.

I currently use Royal Mail delivery service which can take 2-3 days to deliver within the UK. You are encouraged to check their delivery times which may change during busy seasons and bank holidays.

Delivery charges will be calculated and automatically applied to your order during the checkout process on the website, or alternatively quoted by me. Delivery charges will depend upon the delivery method you select, the location of the delivery address, and the size and weight of the products in your order. You are responsible for any local customs duties, tax or other charges levied within your own country for the import of your order.

If you change your mind about an order you have made through this website, you have 14 days to notify me and return the item(s) for a refund. Your returned item will need to be in its original, resellable condition and you will need to pay the shipping cost for this. If you download or stream digital content, you lose your 14 day right to cancel – you will need to let me know you have changed your mind before downloading or streaming.

In the case of cancellations, you will get a refund of anything you have paid directly for stock items. Customised, personalised or otherwise made-to-order items may not be returned under this policy. If you assemble an item (such as a notebook) from stock parts (such as covers, paper and binding tools) that would not be in their original condition when dissassembled, the item cannot be refunded or replaced.

If the value of the stock products returned by you is diminished by any amount as a result of the handling of those products by you beyond what is necessary to establish the nature, characteristics and functioning of the products, I may recover that amount from you up to the contract price. I may recover that amount by deducting it from any refund due to you or require you to pay that amount direct to us. Handling which goes beyond the sort of handling that might reasonably be allowed in a shop will be “beyond what is necessary to establish the nature, characteristics and functioning of the products” for these purposes.

If you need to return or exchange a product, please get in touch to begin the process. Faulty items or parts of those items may be repaired or replaced, if we both agree to that. I will pay for shipment of repaired or replaced products to the customer and the customer will be responsible for return shipment of the product to me. Following confirmation from myself, the item should be returned along with the original receipt within 14 days from the date of purchase, and I will either repair, exchange it or offer a refund based upon the original payment method. Any monetary reimbursements to you will be made within 14 days.

In addition, please note the following: (i) Products can be returned only in the country in which they were originally purchased; and (ii) the following products are not eligible for return: used items, damaged items (unless they are originally faulty).

Privacy

I care about your privacy. Please read the Privacy Policy to learn more about the practices on this website concerning personal information.

​Termination

I have the right to refuse service or cancel a contract of services at my discretion, including without limitation: if you breach the contract, do not pay on time and in full, or if I am prevented from fulfilling the contract between us due to events beyond our reasonable control. I can also permanently or temporarily terminate or suspend your account or access to online services without notice and liability for any reason.

I have the right to refuse acceptance of an order for any reason, including the non-availability of the ordered products. In case of refusal of an order, I will promptly provide for a refund of any payment already received.

You may discontinue use and request to cancel your account and / or any services at any time. Upon termination, your right to use the service will immediately cease. Terms that should survive termination still apply such as those relating to ownership, indemnity and liability.

Liability

I will do my best to provide a safe and secure experience and service. If in some cases this is not possible, I won’t be held legally responsible for any damages or loss resulting from your use, or inability to use, the services.

These terms are in accordance with UK law and any disputes regarding these terms are under the jurisdiction of English courts. Your statutory rights are upheld. If any of these terms are held to be invalid, the remaining terms still apply.

Changes

Please consider reviewing these page periodically as these terms might be updated. If there is a major update, I will notify you via email if you have provided a reachable email address. Revisions to the terms will not affect contracts made before the revisions. If you do not agree with the amended terms, please do not use the Service – continued use implies agreement to the terms.
